Terms and conditions

YELLOVELO ALEX BOUCHER

These terms and conditions form the basis of the contract between us

Yellovelo and you the client. Yellovelo is the trading name of Alex Boucher, SIRET n°44214616300021 registered in France.

The contract, booking conditions and any matters arising from them are

subject to and governed by French law. Yellovelo Alex Boucher holds insurance for “Responsabilité civile professionnelle”.

Please read the Terms and Conditions carefully before initiating a booking.

Your contract is with Yellovelo Alex Boucher (hereafter known as ‘I’ or ‘Yellovelo’).

Please contact us if you have any questions regarding the terms and

conditions, however we do retain the right to change or amend them at any

time.

INTERPRETATION

“I”, “Me” refers, to Yellovelo Alex Boucher

“You”, “Client”, “Guest”, refers to you

“Ride” refers to the on road cycling activity.

“Ride Leader” refers to the member of Yellovelo leading the group of cyclists

participating in the tour/ride.

“Ride Days” refer to the element of your tour that is spent riding on the bikes.

“Free days” refer to days spent not cycling.

“Support Vehicle”, “Support Member”, “Support Driver”refers to the vehicle

and member of Yellovelo that will accompany the group and ride leader on

the ride days.

“Booking Pack” is what you will receive upon booking and will have the

relevant forms we require for your completion, any relevant information for

and from you the client, confirmation of your booking and a booking

reference.

“Group Leader”, “Party Leader” refers to the primary member of your group

that is responsible for the booking on the groups behalf and the point of

contact.

“Arrival date”, “Day of arrival”, Start of Tour”, “Start Date”, “Commencement of

Tour/Ride” refers to the day you are booked to arrive at the destination pre

arranged and within your itinerary where your tour/ride/itinerary starts. “Departure

Day” refers to the date you are expected to finish your tour/ride/itinerary and

return home.

“Itinerary” refers to the tour package that is offered and has been paid for

and what makes up the contents included in the tour. “Tour” refers to the

overall trip that includes your itinerary.

WHAT IS INCLUDED

The details of what is included in your tour/ride are as described in your chosen

Itinerary. Not every Itinerary includes the same services, please read the

Itinerary specific to your ride carefully. Once you have made your

booking, you will be sent a confirmation of the details of what is included. This will serve as a

contract that will exist between both parties once a booking confirmation has

been made and completed stating you agree to the terms and conditions

and have accepted what is included in your chosen Itinerary.

ITEMS NOT INCLUDED

I do not provide insurance as part of our service, rides, tours and packages. You must

have valid insurance that covers you for the full duration of your trip and must

include personal accident cover for you and for third parties in case of an

accident. I advise that you find a policy that includes cover, without

limitations, for any personal possessions including mobiles phones or any

other electronic items you may bring with you and for sporting equipment,

specifically cycles. Any claims arising from matters for which you are insured

must be directed to your insurers.

Where flights, train travel, ferry crossings and other means of transportation to the

location of where your Itinerary is stated to commence that are not included in our

packages/rides, I will not be held liable for any accidents, delays, fines, or

extra costs as a result of your delay. Meals and accommodation not specified

in the Itinerary do not form part of the ride/package. If you choose to extend your

stay after the tour/ride, you will have to make arrangements at your own

convenience. Other items such as personal excursions, hotel phone calls,

internet (if charged), entrance fees, car park fees, taxi fees, Hotel extras e.g.

mini bar & room service and laundry costs are not included. This list is not

exhaustive.

Any other additional expenses incurred during the tour/ride, including but not

limited to unforeseen travel or medical expenses are not incorporated into our

packages/rides. When you are on a Free day where you are not cycling, I will not

provide for any costs outside of what is already included in your Itinerary. This

would include things like excursions, lunches/drinks/snacks, transport to and

from other areas or attractions or costs towards public transport. This list is

not exhaustive. I will not be held responsible for

accidents, damages to yourself or third parties resulting from activities you participate in outside of your Itinerary/ride/tour.

For those people travelling from outside the EU, if required, must provide their

own visas valid for all the countries that are included in your Itinerary. You are

responsible for all visa fees and applications.

I do not provide cycles, wheels, or equipment of any kind, puncture repair

kits or helmets etc. This list is not exhaustive. You are required as the

conditions of our insurers to make sure you have a helmet that is worn at ALL

times when participating in the Rides. Failure to wear a helmet will result in

non participation in the Ride. If you need to purchase or hire a helmet, this

will be at your own expense and you will be required to make sure you have

one that is appropriate and in good condition at the start of the Ride.

I do not service or alter your bikes prior to the Ride. During Training Camps

and

clinics, I may alter the way you are set up on your bike. I offer this only in

good faith

due to the theme of the ride/tour and cannot be held responsible for any after

accidents, damage or injury as a result. You can determine whether you accept

this service or not. You are

responsible to ensure that any alterations etc have been made properly.

Please ensure that your bike is road worthy before you arrive and that you have

the appropriate

spares with you. If I offer to help you at the road side with minor repairs,

wheel changes etc or offer any advise prior, we offer this purely in good faith

and cannot be held liable for any accidents or damage as a result. You are

responsible to ensure that any alterations etc have been made properly.

Transfers may not be included in your itinerary. I cannot offer transfers in Switzerland. I can recommend transfer companies if required . If I’m able to pick you up from a location, I offer this purely as a

gratuity and part of my service at no extra

charge and is entirely at your own risk.

TOURS/ITINERARIES/RIDES

Yellovelo Alex Boucher takes the duty of care and safety of all my clients very seriously and

when taking part in my tours you must abide by all the decisions made by

the Yellovelo Ride Leader that represents Yellovelo. Their decision is final.

When you have completed your booking this will confirm that you are in

agreement with my terms.

If you commit any illegal act when on a Yellovelo tour or if in the reasonable

opinion of the Yellovelo Ride Leader believes that your behaviour is causing

or likely to cause danger, distress or annoyance to others I may terminate

your travel arrangements/ride/Tour/Package without any liability or costs on my part.

Every care and attention has been taken to plan appropriate routes and

accommodation. However, local conditions such as road works & diversions,

adverse weather or local events may require me to change the itinerary at

short notice. In addition the physical condition and/or wishes of the

participants in the group may lead to an alteration of the route. I reserve

the right to alter the Itinerary or accommodation as required and without

liability.

I will always endeavour do my best to allow you to ride at a comfortable

speed within your capabilities, however, I reserve the right to request you to

transfer to our support vehicle if, in the opinion of the Yellovelo ride leader,

the progress of the group as a whole is compromised. When I operate

tours that have a specific Itinerary that requires a ride to be completed within

an allowed time period, I reserve the right to either end the ride earlier and

transfer the whole group, or part of the group that may not be able to

complete the days ride in the allocated time into the support vehicle so that

we can reach our destination safely and with time sufficient time for rest. I

do not lead rides at night and therefore it is always important to keep to

time limits for these and other reasons that are always in the best interests

and safety of the group.

I cannot guarantee the make up of the group in respect of age, nationality,

gender, singles or couples but I do ask that all participants make a

sensible choice of tour that is not beyond their capabilities. Accommodation

that is on a shared basis could mean you are sharing with others

participating on the same tour, confirmation of this will be at the time of booking.

Information is available to help you with this decision on the Yellovelo

website and you can contact us via the Yellovelo website,

www.yellovelo.com or via email info@yellovelo.com for any other questions.

I reserve the right to refuse without liability, to lead you on a ride if you are

in the reasonable opinion of the Yellovelo ride leader, not up to a reasonable

state of fitness required for the level of the cycling tour. You are responsible to

make sure you are properly prepared for your trip and that you maintain a

sensible approach to your health and fitness throughout your stay. If I

suspect your safety or the safety of others is at risk through excessive alcohol

consumption whether from consumption on the day of the ride or as a result

of the previous evening, I may refuse your participation without liability. I

have a zero tolerance for drugs. If I suspect you are using or carrying any

illegal drugs, you will be reported to the local authorities and your Itinerary

will be cancelled immediately without liability, additional costs and no refunds will be made.

If I’m asked by you to provide advice on appropriate clothing, what to

expect from all weather conditions, diet, preparation and equipment etc as

part of your cycling tour, this is done purely in good faith and I’m not liable

if the information is not accurate.

THE COST OF YOUR HOLIDAY & PAYMENT PROCEDURES

I reserve the right to alter prices, promotions or offers of the tours/rides shown on

my website at any time without notice.

The price of your chosen itinerary and what is included is displayed on my

website. When you make a booking, the total amount will be displayed again and what is included

before you continue to book your place on the tour/ride.

Any offers like early booking reductions for example are subject to payment

in full after confirmation of the booking has been sent to you before an agreed date. Payment must

usually  be received in full within 4 weeks of booking. Payment may need to be made earlier if you are booking within these 4 weeks and that of the commencement of your tour/ride. The payment deadline will be

included in your booking confirmation. If the payment has not been made

within the deadline, the offer will expire and your tour/ride will be re released for

public sale and resume its full price. You may then opt to continue with the

booking via means of the standard payment procedure at the full

price.

You will be informed if any changes have been made.

Once I have your booking, I will send you an email to confirm

your place and a complete overview of your booking and how to pay. Once

payment has been cleared you will not be subject to any changes in price.

This includes any rise or reduction in price or offers and promotions.

For all full priced tours/rides that are not subject to a promotion or any offer that

reduces the full price can be booked by paying in full within 4 weeks of booking. If

payment is not received in full and on time, I reserve the right to treat your

booking as cancelled by you. In this case my standard cancellation charges

will apply.

Any other services you may require in addition to what is already included in

your tour/ride that I’m able to organise on your behalf, may be subject to

additional costs. These costs will be disclosed to you prior to them being

booked and you will be billed separate to your booking. I cannot be held

liable for any third party services outside your itinerary.

At the current time, all payments to Yellovelo Alex Boucher can be paid by bacs in Euros.

All details required for payment will be sent with

your booking confirmation.

ALTERATIONS TO YOUR BOOKING

If you need to make changes to your arrangements after they have been

confirmed you must inform me in writing. I will endeavour to accommodate

your requirements but I cannot guarantee such requests. I also reserve

the right to levy an administration charge. Other costs may be incurred.

CANCELLATIONS

In the unfortunate situation that you may have to cancel your tour with me the

following cancellation, charges and conditions apply.

In all circumstances any deposits paid if agreed by Yellovelo Alex Boucher for your itinerary including any

additional services you may have arranged and pre paid will be retained. I

will endeavour to refund the costs any additional services you may have paid

for outside of your Itinerary if this is within my power and will always be

subject to conditions set by any third parties involved. If you have made full

payment and you cancel from after payment has been made and up to 8 weeks from the date of your itinerary, then 90% will be refunded to you. I will retain 10% for admin charges and costs. Within the 8 weeks prior to departure then additional

penalties will apply. Less than 8 weeks prior to the commencement date of

your tour/ride 50% of the total cost will be retained, Less than 4 weeks up to 70%

of the total cost will be retained and Less than 2 weeks 90% of total cost will

be retained. No refunds are available once the itinerary commences.

In the rare event that Yellovelo Alex Boucher is forced due to extraordinary circumstances

or illness etc to cancel an itinerary prior to your arrival date, you will be notified immediately and offered an alternative date if possible or be

entitled to book any other date of the same itinerary and price shown on our

website subject to availability. Terms and conditions will not be affected.

If there are no places available on the dates that are currently running, then

I may, subject to availability, add an extra date or dates. If you accept this

change of date and accept this itinerary and the cost is for any reason is

more than you have paid for the same itinerary, you will be expected to pay

the additional sum. This would be the result of a third party fees beyond my

control and not for any part of the tour/ride under the control of Yellovelo Alex Boucher. If you

accept the difference in costs and wish to proceed, you will then be sent an

amended booking form so that you can read and check you agree to the

changes.

If you decide to choose another itinerary that is offering a different itinerary

and a higher price, you will be expected to pay the difference.

If the price of another itinerary that you choose that is already advertised on

the website is less than the cost of the tour that has been cancelled, I will

refund the difference between the cost of your original itinerary and regular

full price of the replacement itinerary. Any offers or promotional material will not

apply. I cannot guarantee to book you on an identical tour to the tour/ride that

has been cancelled or on a particular week.

If I’m unable to offer a suitable alternative date or itinerary, I will refund

the cost of your Yellovelo itinerary in full.  Excluded from this would be any extra services that you may have booked separately . I will

endeavour to refund the full costs any additional services outside of your

itinerary that Yellovelo may have paid and arranged for you if this is

within my power and will always be subject to conditions set by any third

parties involved.

I reserve the right to adjust any itinerary to suit the conditions and to adjust

the price if required.

In the case of me having to cancel a tour/ride after your arrival date for whatever

reason, I’m not liable for travel, accommodation, meals etc or any other

expenses outside of those already included in your itinerary. If I’m unable

to lead and/or support your ride days for any reason for the full duration of

your tour/ride and have to cancel this inclusion of your tour/ride I will refund you the

reflected part of the cost of your tour/ride.

I reserve the right to change or alter travel arrangements, ride leaders,

availability of support vehicle, accommodation, meals, and other inclusions

of your tour/ride to ensure the continual operation where possible of your tour/ride.

Where possible, you will be made aware of any changes.

In the case of the support vehicle unable to operate as part of the inclusion in

your tour on any given day, I’m under no obligation to provide a

replacement. If I’m unable to provide a support vehicle on the day, I will

still operate a ride if in the opinion of the ride leader it is possible to change the itinerary and

within the ability of the riders. In this case, I reserve the right to alter the route if needed

and the structure and itinerary of the ride. In the case of no support vehicle if this option has been booked, I will only refund the difference in price between our supported and non supported itinerary. If for any reason your ride leader is unable to physically lead the ride on his cycle, he/she may choose to

accompany the support vehicle to provide any assistance from there. The

ride will in all cases then be guided from the support vehicle and will still provide the guiding as stated on your itinerary. Alternative

routes may or may not be used. You will be made aware of this prior to the

tour/ride or continuation of the tour/ride and given full instruction of the days itinerary.

YOUR BOOKING

Following initial contact with me, I  will send you an email confirming the service and price I can offer you for the itinerary you have requested.

All persons included in the booking must be named in full upon booking and by

doing so they are accepting the terms and conditions laid out on this page

and giving me directive to perform services for them on your behalf.

Your booking is accepted on the condition that you understand and accept

the risks and hazards of such a holiday. There are always elements of risk

when participating in any sport including road cycling and all risks either on

the road or off the road must be taken into consideration. Risks to consider

and this list is by no means exhaustive are, adverse weather conditions, the

poor condition of the highways, other vehicles, cyclists and road users,

failure of equipment, terrorism and poor health and disease. There is also the

potential for and again this list is not exhaustive, delays, alterations, loss or

damage to property, inconvenience and discomfort.

A copy of these terms and conditions will be attached to my email when you receive your

booking confirmation. On booking,  you are required to complete and return

any information I require for the itinerary you are participating in. I will ask you to confirm that you accept our terms and that you are aware

of all risks. Your booking reference will be your surname and the date of your itinerary.

The prices shown are per person. Accommodation is usually based on shared

occupancy. You can request single room occupancy and you must be aware that the cost may increase for this option. Some of the chalet accommodation we may use in certain itineraries

have single occupancy rooms or rooms for couples. These rooms are sold on

a first come first serve basis. I cannot guarantee you these rooms and may be

subject to a supplement fee. When using hotel accommodation it is based on

double occupancy of rooms. Single rooms when using hotels are subject to

availability and we cannot guarantee them. Single room supplementary

charges will apply. Some hotel accommodation offer apartments and I

reserve the right to use apartments or change and alter accommodation if

necessary to ensure the continual operation of the tour/ride.

I host our groups to a maximum of 6 on all tours. Exceptions to this maybe

be possible after considerating safety and the makeup of the groups

dynamics. This would be purely up to the discretion of Yellovelo Alex Boucher if we deem it

feasable. Safety is always paramount which is why I don’t believe in huge

numbers for our groups. A minimum participation is required for all tours and

if for any reason this falls below the required numbers, then Yellovelo Alex Boucher reserve

the right to amend, cancel, or postpone to another date.

Please contact me about group availability. Wherever possible if a group

booking requests it, I may create a new tour/ride or amend an existing tour/ride to

accommodate your needs further. I’m happy to receive enquiries for

bespoke tours at any time. I’m not confined to any particular area or

country and I’m always up for a challenge just like you! I would however

advise that there is time needed in planning a tour/ride that is outside of the

areas I usually operate in. Not only does it take time to organise the obvious things

but I would want to ensure everything has been personally inspected and

the area and roads surveyed and cycled/driven by myself. This insures

that I’m sufficiently prepared.

On holidays of this kind it is key to be flexible and open minded for the

unconventional and potential for the unexpected. The day to day agenda and

ultimate goal of the tour/ride should be aimed at an adventure, a challenge

perhaps, to expand your cycling habits, skills, ability, a way to make new friends and see the

countryside and take in the views and have an overall new experience that

you will enjoy sharing with others and is not taken as a contractual obligation.

It is a fundamental condition of booking that you accept this flexibility, and

acknowledge that delays and alterations and their subsequent results, such

as inconvenience, discomfort, or disappointment, are possible.

FORCE MAJEURE

I cannot accept liability or pay any compensation where the performance

of my contractual obligations is prevented as a consequence of ‘force

majeure’. In these terms and conditions ‘force majeure’ means any event

which I or the supplier of the service or services in question could not, even

with all due care, foresee or avoid. Such events may include war or threat of

war, riots, civil strife, terrorist activity, industrial dispute, health risks, natural or

nuclear disaster, adverse weather conditions, fire, road closures and all similar events out of

my control.

TRANSFERS & TRANSPORTATION

Transfers may be given by my own driver and vehicle or with a third party provider if requested.

It may be necessary

sometimes to combine guests arriving or departing on different flights which

may require additional waiting time at the airport. I would always try to

keep this additional waiting time to a minimum but some cooperation on your

part may be required in any event.

On departure I will allow adequate time to transport you safely to the airport

in good time and to allow you the time upon arrival that is required prior to

departure for passport and baggage control etc.

You must ensure you have allowed sufficient time to leave your

accommodation, settle any bills, return or pack any equipment etc before

your transfer is scheduled to leave. I will not be liable for any losses or

delays if you are not a position to leave the resort at the time I specify.

However, I understand sometimes things do not run as planned and very

occasional unforeseeable and exceptional circumstances may delay the

transfer. I will not be liable for any losses incurred by you as a result. Any

losses, delays or cancellations etc should be taken up with your insurance

providers.

All travel in my vehicles or those of third party providers is entirely at your

own risk.

BEHAVIOUR

I expect all my guests to treat each other and other people with respect

and kindness. I will no tolerate any aggressive behaviour towards

myself at Yellovelo or towards other guests or third parties. Should I feel

your behaviour is inappropriate and impeding on others participating in the

tour, I reserve the right to end your tour/ride and without liability, costs or refunds.

You are expected to abide by the rules of the designated leader or other

members who represents Yellovelo Alex Boucher and whose decision is final. You must also

abide by the rules of any third party involved as part of your package, for

example, accommodation providers, transfer companies, restaurateurs, etc.

You are also expected to keep noise to an acceptable level in and around the

accommodations and respect your surroundings. Any deliberate breakages

or vandalism will be charged at your own expense. Any Illegal activities will

be reported and I reserve the right to cancel your tour with no further

liability, costs or refunds.

Please do not throw any rubbish into the roads or countryside when on your

bike. A bin will be available on the Yellovelo Support Vehicle. Smoking is not

permitted in any Yellovelo vehicles or accommodation. If you choose to

smoke please refer to designated smoking areas if there is one allocated and

abide the rules of third party providers on their own smoking policies. Please

dispose of your litter and cigarette butts in a safe and environmentally

respectful manner.

LIABILITY

Yellovelo Alex Boucher is not liable for personal injury, death, damage to property or

other loss whether arising from accident, cancellations, delays or any other

matter beyond my control.

Guests should find suitable cover to include protection against all such

possibilities. Please read your insurance documents given to you by your

insurance provider carefully.

The use of any swimming pool, sauna, hot tubs or any other spa facility are at

your own risk.

MEDICAL AND SPECIAL REQUIREMENTS

It is your responsibility to ensure that you are sufficiently fit, healthy and

prepared to complete your chosen tour/ride. Preparation and training is essential

for these types of tours/rides.

If you are affected by any condition, medical or otherwise, that may affect

your or other people’s enjoyment of the holiday, you must advise me before

booking so that I can make an informed choice to weather the type of tour/ride

you have chosen is right for you or if I can make any reasonable

adjustments. This includes any allergies to certain foods or other. If I’m

not informed of any special dietary requirements in advance, I may not be

able to offer you a suitable alternative. Any information you can provide will

always help me to satisfy any needs where possible. If you fail to disclose this

information to me after you have completed your booking and it effects the

dynamics of the tour and other participants I may cancel your holiday at

any time and cancellation costs may apply. I cannot be held responsible

for any medications lost, spilt, soiled etc.

Medical treatment overseas and the cost of repatriation in the event of an

emergency can be very expensive and so it is vital that you are adequately

insured. It is a condition of your booking that you have appropriate insurance

and you are required to confirm you are adequately insured on when booking.

You will need to provide me the name of your insurance providers, policy

number and helpline number in case of emergencies. I advise you have

some form of worldwide accepted payment facility with you like a credit card

as many emergency providers will require this upon initial treatment. I

cannot provide any form of monies needed to cover medical assistance

whilst on any part of the tour/ride and I’m unable to accept responsibility for

any costs that you or anyone in your party may incur as a result of failing to

take out adequate insurance.

My team is only trained in basic outdoor emergency first aid and is not

expected to treat, or perform any procedures beyond our capabilities or

administer any medication including pain relief such as aspirin, paracetamol

or ibuprofen. Any medical attention or advise that you require is should be

given by a trained medic or doctor. I carry a first aid kit onboard our

vehicle that I would use in an emergency. I cannot be held liable for any outcome when helping a rider resulting in death, further

injury or damage to clothing or equipment etc as a result of administering

basic first aid. You will be asked if you agree to receive

first aid in case of any emergency.

PASSPORT & VISA REQUIREMENTS

I cannot accept any liability if you are refused entry onto a flight or into any

country due to failure on your part to carry the correct or valid passport,

required visas or other documents required by any airline or authority on

border control.

Valid passports are a legal requirement needed to travel into The UK, France,

Switzerland and Italy and you may at any time be required to present them to

the local authorities and accommodation providers including Yellovelo Alex Boucher

upon checking in. I cannot be held responsible for any loss, damage or

theft of passports and you will be responsible for replacing them should you

be required to at your own time and expense. Please check your Itinerary for

countries you will be visiting as part of your Itinerary.

COMPLAINTS AND GRIEVANCES

If you have any complaints or grievances however small, you must inform a

member of Yellovelo at the earliest opportunity. I welcome every

opportunity to put things right if they do not meet your expectations and will

attempt to resolve the issue as soon as possible if it’s within my capabilities.

If you have any grievances with any other member of the group participating

in the tour, a third party or a member of Yellovelo, I will treat your complaint

promptly and discreetly and anonymously if you so desire. At the end of your

tour/ride we hope you will have enjoyed every part of it. If however you feel

that your complaint has not been properly addressed you must notify me in

writing within 28 days of your scheduled date of return.

OTHER

I’m happy to be approached as much as you need with any questions

you may have. Email costs nothing but the answers could be invaluable. I

would like to offer any advice but please note this is purely given in good faith

and I cannot be held responsible for any inaccurate information given.

Please check the details yourself from a reliable source, it is only my advice, opinions or experience that I answer you with!

The ride leader that Yellovelo Alex Boucher is a fully qualified guide, trainer, coach or

instructor. Your ride leader and support driver will not take

responsibility for decisions you make regarding the continuation to ride in poor conditions, on closed roads or after injuries if they have been deemed conditions unfit to continue by a member of the Yellovelo team.  If you choose to continue against advise, you will need to complete a disclosure releasing Yellovelo of their obligations, responsibilities and liabilities of the itinerary and the ride will end from that moment on. You will be responsible for all your own actions and returning to your base.
